Hereinafter referred to as the "Seller",

1.OBJECT OF THE CONTRACT

The present general terms and conditions of sale are applicable between the company PHÔS and any person (hereinafter referred to as the "Customer") making a purchase through the website www.VENTE-LUSTRES.com, (hereinafter referred to as the "Website").

Any order implies the express and unreserved acceptance of these general terms of sale.

2. ACCEPTANCE OF THE OFFER

The Customer can take note of the essential characteristics of the Products marketed on the Internet Site prior to placing an order, in particular by viewing the photographs put online and the descriptions made.

However, the photographs are likely to modify the appearance of the products, particularly their color.

The steps for placing an order are as follows:

- Adding products to the cart;

- Validation of the cart by clicking on the words "POURSUIVRE VOTRE COMMANDE";

- Fill in the personal data necessary for the creation of the contract and the delivery of the products;

- Acceptance of the general conditions of sale;

- Information of the banking data or bank transfer.

The order is definitive as soon as the bank transaction is finalized and the delivery terms are decided between the two parties.

3. PRODUCT AVAILABILITY

The Products are offered within the limits of available stocks.

In the event that a Product ordered is temporarily unavailable, the Seller will send an e-mail to the customer to inform him/her of the estimated delivery date.

The Customer will then have the right to cancel the order of the unavailable Product without any charge.

In case of definitive unavailability of the Product, the Seller will suggest a similar product.

4. PRICE

The prices displayed are exclusive of tax, delivery and logistics costs.

Online payment by credit card requires entering the credit card number, its validity date and its cryptogram.

The Seller uses a secure payment system so that the Customer's personal information is encrypted before being transmitted to the payment center.

Any delay in payment shall result in the payment of an indemnity at the contractual rate of 10% of the amount due, without any prior notice of default.

The Products remain the property of the Seller until the end of the transaction.

5. DELIVERY

The information provided by the Customer when placing the order is binding and PHÔS cannot be held responsible for delivery errors or the non-delivery of Products when they result from errors made by the Customer in the information provided, notably with regard to his/her name or address.

The order is shipped at the latest on the date indicated when the order was placed.

Delivery costs are the responsibility of the Customer.

PHÔS cannot be held responsible for delays in delivery due to the carrier. Consequently, a delay in delivery shall not give rise to compensation on the part of the Vendor.

The terms of delivery are presented on the Delivery page as well as the products’ descriptions.

6. RIGHT OF RETRACTION

The Customer has a period of 7 days from the date of receipt of the Products to exercise his right of retraction and return all or part of his order.

At the end of this period, any request for withdrawal will be refused.

Any request for cancellation will also be refused, even if it was made within the time limit, if the returned Products are not in perfect condition.

To exercise their right of retraction, the Customer must return the product at their own expense. In the case of a return of the entirety of the ordered products, the expenses of return of the products will be the responsibility of the purchaser.

Upon receipt of the Product, the Vendor shall proceed to reimburse the price of the returned Product as soon as possible and at the latest within 15 days following the date on which the Customer has exercised his right of withdrawal.

In the event that the customer returns only part of the Products in the order, the Seller shall not refund the delivery charges initially paid.

7. GUARANTEES

Any complaint is only admitted if it is sent by registered letter with acknowledgement of receipt to the Seller's head office.  

The Seller guarantees the defects of conformity of the goods and the hidden defects of the sold item during two years.

In case of non-conformity of the delivery with the order, we are responsible and we commit ourselves to do what is necessary to honor your order as soon as possible.

8. INTELLECTUAL PROPERTY

All elements on the site created by PHÔS are its property and the company holds the copyright on the original elements.

Any copy without the prior consent of PHÔS is forbidden.

9. RIGHT TO ACCESS, OPPOSE, RECTIFY OR DELETE PERSONAL DATA

The Seller reserves the right to use the personal data it may have collected for further commercial action.

In accordance with the French law n° 78-17 of January 6, 1978 relating to information technology, files and freedom, the Customer may exercise his or her right of access, opposition, rectification and deletion of data concerning him or her by contacting the Vendor at the address of his or her head office, namely

10. JURISDICTIONAL CLAUSE

The contract is governed by French law.

In the case of a sale to a professional, only the French courts are competent.
